Driving under the influence of drugs case dropped

Another great result achieved by Mia Twomey after her client had charges of driving under influence of drugs dropped.

The case circumstances

Our client was initially pulled over by the police on suspicion of insurance fraud. His insurance was not held under the new address that he had recently moved to. He told the police that he had tried on multiple occasions to get this updated. The police then asked him to do a preliminary drug test at which point he told them he had smoked cannabis the night before as per his medication prescribed for his anxiety and depression.

He then tested positive and subsequently received a postal requisition for a court appearance at Bromley Magistrates Court.  MK Law represented him at the first hearing where he pleaded not guilty and it was adjourned for a later date.

Case mitigation

Mia went about gathering all the evidence as mitigation. This included

  • The letter from the DVLA outlining that the defendant had informed them of his medication intake and deemed him fit to drive.
  • A report by a drugs expert to prove he was taking the dosage he was told to take.
  • A copy of the defendant’s prescription including dosage advice on the sticker of the medication
  • Letter from his doctor explaining his treatment and the reasons why he would need such treatment.

All the evidence was provided alongside detailed representations to the Crown which led to them discontinuing the case!

Our client was over the moon, because he was suffering from depression and anxiety and this trial was making it worse. He was so relieved when Mia told him that a week before the trial was due to start the case had been dropped.
